IoD event to explore impact of Carlyle case

The judgment in favour of Executive and Non-Executive Directors involved in the Carlyle Capital Corporation case forms the basis of a panel discussion at the second seminar in the JT Winter Series, staged by the Guernsey branch of the Institute of Directors.

The seminar, which will be held in the Dorey Room at St James from 12.30 to 2pm on Friday 26 January, will ask: Does Carlyle raise or lower the bar for Directors and NEDs?

Lawyers Gareth Bell of Collas Crill, who represented the NEDs, and Ian Swan of Babbé, who acted for the Directors, will discuss the implications of the case and other relevant matters and whether it is still an appealing prospect to sit on the board of financial institutions. 

Directors and NEDs Anne Ewing, Peter Mills and Rupert Dorey will be among the panellists.

Linda Johnson, Chair of the IoD Guernsey branch, said: “The judgment may have brought clarity around certain obligations of Directors, but does the prevailing fear of litigation mean the prospects facing Directors are becoming increasingly challenging? Are those risks just too high or are the rewards worth it, reputationally, financially and personally?”
