Draconian injunctions often obtained on the basis of fraud are the subject of the final event in the Collas Crill Spring Seminar series on 15 May 2012 (in Guernsey) and 16 May (in Jersey).

In these financially straitened times, creditors are becoming more inventive and aggressive in the protection, recovery or replacement of their assets.

As the financial crisis leads to the uncovering of fraudulent activity, the use of investigatory and pre-judgment measures, such as search, freezing and fraud investigation orders, is increasingly prevalent.

The effect on financial services businesses can be significant as they are forced to walk a tightrope between the order's often draconian requirements and their own obligations to their client.

The final event in Collas Crill's Spring Seminar Series – on Wednesday 15 May in Guernsey / Thursday 16 May in Jersey – will look at the investigatory and pre-judgment toolkit and consider from a financial services perspective what steps a business should take when they are the subject of, or affected by, an order.

These draconian injunctions have serious implications and ramifications for unwitting third parties with, in particular, the potential to place them at odds with their own obligations to their client.

"Creditors are seeking increasingly aggressive steps to recover monies, and so the likelihood of being caught up in proceedings has certainly increased as a result of the current financial crisis."

Throughout the firm's Spring Seminar Series, expert speakers from Collas Crill and London law firms have been discussing issues relevant to professionals in trusts, banking, accountancy, property, retail and management, particularly focusing on practical tips to face the challenges of the year ahead.

The guest speaker at this event is Jane Colston from Stewarts Law LLP. Jane has acted for numerous corporate victims of fraud and has extensive experience of forensic investigations, most of which have involved working with teams of investigators and accountants, and coordinating lawyers in multiple jurisdictions to trace and freeze assets. Jane has managed numerous cases involving freezing, search, disclosure, gagging and delivery up injunctions as well as breach of confidence claims.
