Drafting trusts book published

Carey Olsen fiduciary partner Paul Matthams and James Kessler QC have published the second edition of Drafting Trusts and Will Trusts in the Channel Islands.

The book, which has been published by Sweet & Maxwell, is the Jersey and Guernsey Law contribution to a series covering Wills and Trusts in different jurisdictions written by James Kessler QC with various co-authors. In addition to Jersey and Guernsey, the series now includes Australia, British Virgin Islands, Canada, Cayman Islands, New Zealand, Northern Ireland and Singapore.

The second edition gives further expert guidance on best practice when drafting and reviewing trusts under Jersey and Guernsey law.

Paul Matthams, head of the Carey Olsen fiduciary law group in Jersey, said: “This series of books has been an invaluable source for trust practitioners for many years and once again I am delighted to have been involved in the production of another Channel Islands edition.

“This latest edition covers the relevant developments in Guernsey and Jersey trust law since the first edition was published in 2006. During this time Guernsey has enacted a new trusts statute while Jersey has further amended its 1984 trusts legislation and has introduced civil partnerships and, significantly, both jurisdictions have introduced the civil law concept of the foundation into their local legislation.”
